In this class action, plaintiff Ann Bruck alleged that Tenet Healthcare Corporation improperly classified a class of case managers as exempt from overtime. She argued that her job did not allow her the requisite level of independent judgment and discretion to qualify her position as exempt. She argued that doctors overseeing the patients made the important decisions as to their treatment. Defendants agreed to a settlement to pay class members not more than $3 million dollars. Defendants agreed to pay an additional sum of $500,000 to cover attorney fees. In addition, Defendants agreed to include the members of the class as class members of a separate class action brought on behalf of non-exempt employees for meal and rest breaks.
